KING COUNTY
SUPERIOR COURT CLERK
E-FILED

CASE #: 25-2-11308-6 SEA

SUPERIOR COURT OF WASHINGTON

FOR THE COUNTY OF KING
Mathew W Ralidak 6/12/1986 | No. 25-2-11308-6 SEA
Petitioner Date of Birth
RESPONSE DECLARATION OF MATHEW
Vs RALIDAK, RESPONDENT
Veronika E. Goodnight 2/15/1982
Respondent Date of Birth

Iam over 18 years of age and am the Respondent.

I declare:

No Notice and Lack of Service

1.

I filed my petition for protection on April 11". The court considered the document
submitted and testimony provided by both parties and signed a permanent DVPO on April
25, 2025, following a hearing. Our three children are included in the protection order.
Unbeknownst to me, the Respondent obtained an ex parte Finding of Adequate Cause and
Order for Hearing on Restrained Person’s Motion to Modify or Terminate Protection
Order and filed a motion to terminate the protection order. I was not given notice of the ex
parte presentation, no hearing was scheduled, and I was not served with copies of the
documents prior to their presentation to the court. It appears the Respondent went in
person to ex parte and had the Order for Adequate Cause signed the same day. I was

denied the opportunity to submit any evidence for this hearing. The court only considered

the false allegations and documents submitted by the Respondent. I have attached a copy
of my KC Script messages, which confirm that none of the documents the Respondent
presented to the court on 4/29/25 were eserved on me. See Ex. A.

3. Iwas served at our daughter’s softball game on Saturday, May 3" the following: Notice of
Hearing, Motion to Modify the DVPO, Adequate Cause Hearing Order, and only one page
of the Sealed documents, which the court docket reflects is 59 pages.

4. Iwas not served with documents filed by the Respondent, sub ##: 9, 12, 13, 14, 19, 20, 30
(I only received 1 page of 59), and 40. I spent $215.39 purchasing documents which I was
not properly served with.

5. The Respondent also has been filing documents in our family law case without notice to
me. King Cty. # 20-3-03830-3 SEA. She filed 9 documents on 4/29/25 which were not
served on me (sub ## 361-369). I only found out about these on 5/6/25 after review of the
court docket and after I had submitted my Petition to Modify the Parenting Plan as I was
ordered to do in this case.

Basis of Motion

6. The statements in Veronika’s 4/25/25 declaration stating she “only” spanked Raina twice
({2), contradict the three therapist records (each child has their own therapist) that I filed
on 4/24/25 under seal. All confirm each child self-reporting abuse by their mother
independently. The therapy records and statements made by the children are consistent and
collaborate with one another. The only inconsistency is Veronika’s statement. See
supplemental therapy notes from 4/23/25 filed under Seal.

7. The court, after reviewing these documents, stated in its 4/25/25 DVPO order, “...the
allegations and statements in the therapy notes are extremely concerning.” The court found

the therapists’ records to be credible. It seems the Respondent is implying that all three

10.

therapists are lying. She specifically called our youngest daughter a liar in her motion and
in open court on 4/25/25.

Veronika states I “blocked contact” with the children. Mot. 75. This is false. I complied
with the court ordered DVPO which states I must allow children and mother to
communicate telephonically at least once a day. I have provided call history which shows
the children tried numerous times a day to reach their mom, but she refused to answer their
calls. See history attached as Ex. B. She even sent me a message between two of their call
attempts but still refused to answer the phone. /d. The behavior does not make logical
sense but given her mental health issues, I suppose not surprising per se.

The Respondent states that the principal “denies making any statements against me.” Mot.
45. This is also false. The principal stated she did not make any “formal statements”
against her. This is true. However, she verbally stated to the sheriff when they were called
to the school for the incident on 4/4/25 that prompted my DVPO request, that Veronika
had disrupted school before. I have her statement on the video provided by the sheriff and
can produce it to the court if needed.

Veronika disclosed to me that she was diagnosed with borderline personality disorder
years ago but accuses me of providing a false medical history to the children’s

pediatrician.

I complied with the 4/25/25 DVPO

11.

12.

I had the children contact their mother at least once a day. See Ex. B.

I filed a motion for a parenting plan modification on 5/5/25. The Adequate Cause Order in
this case dated 4/30/25, stated I did not file a Motion to Modify. At that time, I had not.
The Adequate Cause order was obtained five days after the DVPO was entered. I was not

able to complete all the necessary documents in five days, which is an unreasonable

expectation, as I work full time to support my family, have the children full-time, and my
evening are filled with sports activities for the children.

I would also like to note that my actions in regard to selecting, scheduling, and following
the pediatrician’s recommendations are in compliance with our parenting plan. Veronika’s
dissatisfaction with the authority the court gave me, does not make me in violation of our

parenting plan.

Respondent’s Violations of the DVPO

14.

15.

16.

17.

The court stated in the DVPO order, that “Protected party must file a modification order for|
the family law court to consider” and “‘The family law court is the best place to determine
final matters.” Again, unbeknownst to me, the Respondent filed a Petition to Modify the
Parenting Plan, and obtained another Adequate Cause Order on 4/29/25 without notice to
me. The only reason I became aware of her filings was because I randomly searched the
court docket. I received some of the documents on 5/5/25.

The Respondent has repeatedly violated this 4/25/25 Court’s DVPO, starting on the day the
DVPO was granted. After a few weeks of Respondent’s frequently messaging me in spite
of the no contact provision in our DVPO, I reported the violations to the Sheriff on 5/7/25.
The responding Sheriff took my statement over the phone, then traveled to meet me in
person to gather evidence, and provided me with Case # C25013864.

The Sheriff asked that I report any other violations to the Sheriff's office. The Sheriff also
confirmed that communication between Veronika and myself should be initiated though me|
and only for the purpose of connecting the children with her. She should not be contacting
me.

Veronika demonstrates her intent to continue violating the DVPO. As stated in her
declaration dated 5/8/25, 9/4, she intends to keep violating the protection order. The DVPO,

prohibits her from having any contact with me, including through third parties. Her intent

to have her fiance’s daughter attend our daughter’s DR appointment is a clear violation of

the order. See 78(B). She had the children talk to Colin during a recent video call, a

violation of her DVPO and Colin’s (case #25-2-11317-5).

Submissions of the Respondent

18. The Respondent filed four declarations (sub ## 19, 23, 37, & 40) totaling 204 pages for
this hearing. I was not served with any of these documents. I purchased them after seeing
the filings on the court docket. I object to a majority of the information and testimony
provided in her documents as most of the requests should be addressed in our family law
case.

19. As the court already determined in its 4/25/25 Order, “The family law court is the best
place to determine final matters.” See p. 10. Additionally, most of the information
produced has already been litigated in our family law case, during our trial in June of
2024. Current evidence provided shows a pattern of abusive and disturbing behavior by
the Respondent which was the foundation of the court’s decision to grant the DVPO on
4/25/25.

20. Although I feel it is not a good use of the court’s time and resources, I will briefly address
a few of the misstatements of the Respondent.

a) Declaration of Veronika, sub 19. Respondent states that having a DVPO against her
was “traumatic” (see page 2) while failing to acknowledge or take responsibility for
her actions that led to the DVPO.

b) Yes, I asked the Respondent to take my mid-week visit on 4/16 because I was
scheduled to be out of town for work. This request to her was prior to finding out about
her abuse of the children and her harassment at the children’s school on 4/4/25. After

this incident and entry of the DVPO, I cancelled my work trip to stay with the children.

--- Page 6 ---

20

21

22

23

24

25

c) Veronika alleges I’ve used CPS and healthcare to harm her. I have not. Several of the
CPS calls were not initiated by me but by concerned mandatory reporters. Sub 19, p, 3,

d) Iam authorized with sole decision making to select a medical DR/pediatrician for the
children and to “pursue any course of action recommended by the pediatrician.” Final
Parenting Plan, p. 9, dated 6/25/24. 1 may also, “have the children receive all
vaccinations recommended by the pediatrician...” Jd., p. 10.

e) Declaration of Veronika, sub 23, includes statements containing hearsay, false
information, and primarily focuses on matters which should be bought to family court.
Exhibits A(d)-(f), (k)-(u), Exhibit B, were already brought to the court’s attention and
considered during our family law trial in June 2024. Exhibit A(h) and (j) should be
stricken for failure to comply with court rules.

Conclusion
21. The escalation of the Respondent’s harassing behavior includes violating our Parenting

Plan by communicating with me directly at our children’s school on 4/4/25, verbal abuse

and manipulation the Respondent subjects the children to, and violations of the DVPO and

Parenting Plan. These actions make it imperative for this DVPO to remain in place and for

all communication, with the children and with me, to go through Talking Parents.

Communication needs to be monitored and recorded for the safety of our children and

myself.

I ask the court to keep the protections in the DVPO in place and deny the Respondent’s

request to dismiss the DVPO, for make-up time.

I declare under penalty of perjury under the laws of the state of Washington that the facts I have
provided on this form (and any attachments) are true. [X] I have attached (number): 7 pages.
